TERMS AND CONDITIONS OF SERVICE

1. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal disputes must be handled exclusively in the courts of Ontario.
2. Estimates and Authorizations (Ontario Consumer Protection Act)
In accordance with the Ontario Consumer Protection Act, 2002:
- We will provide a written estimate before starting work, unless you waive the right to an estimate or specify a maximum amount you are willing to pay. [1]
- We will not charge you more than 10% above the estimated cost, up to a maximum variance allowed by law, unless you explicitly authorize the additional work and cost. [1]
- You may choose to have changed parts returned to you, provided you request them before the work begins, unless the parts are under a warranty replacement or core charge program.
3. Authorization to Drive Vehicle
You grant our employees and technicians permission to operate your vehicle on public streets or highways for the sole purposes of testing, diagnosing, inspecting, or delivering the vehicle.
4. Vehicle Delivery, Towing, and After-Hours Drop-Off
- Towing: We do not provide towing services. If your vehicle requires towing to our shop, you are solely responsible for arranging and paying for a third-party towing service.
- After-Hours Key Drop-Off: If you utilize our after-hours key drop box, you acknowledge that your vehicle is left on our premises at your own risk until our business opens, our staff retrieves the keys, and we formally accept custody of the vehicle. We are not responsible for any theft, vandalism, or damage occurring prior to opening hours.
5. Customer-Supplied Parts Policy
If you request that we install parts provided by you rather than parts sourced through our verified jobbers, the following terms apply:
- Labour Surcharge: Our standard labour rate will increase by 30% for the entire service to cover the additional administrative costs and service writer wages involved in managing outside components.
- Warranty Disclaimer: We provide zero warranty on customer-supplied parts or the labour associated with installing them.
- Warranty Claims: You act as your own warranty manager. If a customer-supplied part fails, is defective, or is incorrect for the vehicle, you are entirely responsible for all costs to remove, replace, return, or re-install the part. We do not provide jobber-backed parts-and-labour protection on items we did not supply.
6. Repair Times and Delays
Any completion times provided are estimates only. We are not liable for delays caused by parts availability, shipping delays, unexpected mechanical complications, or events beyond our reasonable control.
7. Payment and Mechanic’s Lien
- Full payment is due immediately upon completion of the Services and prior to the release of the vehicle.
- We accept: Cash, Debit, Visa, Mastercard.
- Under the Ontario Repair and Storage Liens Act (RSLA), we hold a statutory lien against your vehicle for the amount of any unpaid repairs, storage fees, or services. If payment is not made, we reserve the right to retain, seize, or sell the vehicle to recover the debt.
8. Storage Fees
Vehicles left on our premises for more than 48 hours after you have been notified that the Services are complete will be subject to a storage fee of $50.00 per day, plus applicable taxes, as permitted by the RSLA. Unless a longer period has been mutually agreed upon
9. Limited Warranty on Shop-Supplied Parts and Labour
- Labour Warranty: We warrant our repair labour for a period of 90 days or 5,000 kilometres, whichever occurs first, from the date of service. This applies only to services using parts supplied by our shop.
- Parts Warranty: New parts installed from our jobbers are subject to the manufacturer’s warranty.
- Exclusions: This warranty does not cover customer-supplied parts (as detailed in Section 5) or damage caused by vehicle abuse, racing, accidents, neglect, alterations, or repairs performed by third parties.
10. Limitation of Liability and Personal Property
- We are not responsible for loss or damage to the vehicle or its contents due to fire, theft, vandalism, or accident, unless caused by our direct negligence.
- Important: Please remove all personal belongings, valuables, and electronics from your vehicle prior to service. We are not responsible for any lost or stolen personal items left in the vehicle.
